Terms of Service

1. Agreement and who we are

These Terms of Service are an agreement between you and AcuPrep LLC, a Virginia limited liability company — the independent company that owns and operates the AcuPrep service at acuprep.com (“AcuPrep”, “we”, “us”). By creating an account or using AcuPrep you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and minors

AcuPrep is an invite-only SAT preparation service currently offered only to residents of the United States and for students 13 and older. Children under 13 may not use AcuPrep, and we do not knowingly allow them to create accounts. If you are under 18, a parent or legal guardian must review and agree to these terms with you, you must provide a parent or guardian's email address, and your guardian must separately confirm the account before AI tutoring, voice, coaching, or persistent tutor memory is enabled. Basic non-AI practice remains available while confirmation is pending. Any paid subscription covering you must be held by an adult — students under 18 cannot purchase a subscription themselves.

3. Accounts and roles

Student accounts are for one student's own studying. Parent accounts can link to their student's account — only when the student has named that parent's email as their guardian — to view progress and manage the subscription that covers the student. You are responsible for your sign-in credentials and for all activity under your account; accounts may not be shared. Tell us immediately at support@acuprep.com if you believe your account has been compromised.

4. Subscriptions, trials, and billing

Paid plans are billed through Stripe at the price and on the schedule shown at checkout (your statement will show ACUPREP.COM). Subscriptions renew automatically at the end of each billing period until cancelled. Free trials automatically convert into the paid plan you selected at checkout unless you cancel or switch plans before the trial ends; the trial's end date, selected-plan features, usage limits, and converting plan are shown before checkout and in the product. Plan changes during a trial are free and do not reset its original expiration or usage already consumed; changes to an active plan are prorated as shown at the point of change. Prices exclude tax, which is calculated and added at checkout. We may change prices with advance notice; a price change takes effect at your next renewal, and you can cancel before it applies.

5. Cancellation and refunds

You can cancel any time from Settings (via the billing portal). Cancelling stops the next renewal; you keep access through the end of the period you already paid for. Cancelling during a free trial means you are never charged and you keep access through the trial's original expiration. Except where required by law, payments already made are not refunded — if you believe you were billed in error, contact support@acuprep.com and we will make it right.

6. AI features

AcuPrep includes AI-powered tutoring, coaching, and study tools. AI output can be imperfect or incorrect; it is study assistance, not professional advice, and no score outcome is promised or guaranteed — results depend on the student. Metered AI features (tutor questions, voice minutes, Desmos walkthroughs) are subject to the allowances disclosed for the applicable offer. Trial limits are shown before checkout; we will disclose any paid-plan limit before it applies.

AI personalization and persistent tutor memory require a separate, revocable choice from the student and, for a student under 18, confirmation from a parent or legal guardian. Turning those features off does not prevent the student from using basic non-AI practice.

7. Acceptable use

Do not: share or resell access; copy, scrape, or redistribute questions, explanations, or other content; attempt to extract answer keys or probe the service's security; use automated agents against the service; misrepresent your age or identity; or use AcuPrep to violate any test administrator's rules. We may suspend or terminate accounts that violate these terms, with a refund of any unused prepaid period only where the violation was not willful.

8. Our content and intellectual property

AcuPrep's questions, explanations, reference materials, software, and design are the intellectual property of AcuPrep LLC, licensed to you for your own personal, non-commercial study while you have an account. Feedback you send us may be used to improve the service without obligation. SAT® is a trademark registered by the College Board, which is not affiliated with and does not endorse AcuPrep or AcuPrep LLC. Desmos and related trademarks are property of Desmos Studio PBC.

9. Third-party services

The service is built on third-party infrastructure and model providers (described in the Privacy Policy), including Stripe for payments and the Desmos graphing calculator. Their availability is not within our control, and your use of Stripe's checkout is also subject to Stripe's terms.

10. Termination

You may stop using AcuPrep and request account deletion at any time. We may suspend or terminate the service or your account for breach of these terms, for legal or safety reasons, or if we discontinue the service — in the case of discontinuation we will give reasonable notice and refund any unused prepaid period. Sections 8 and 11–13 survive termination.

11. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that practice scores predict official scores. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, AcuPrep LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities (including test outcomes or admissions decisions), and our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or US$50 if you have paid nothing). Nothing in these terms limits liability that cannot be limited by law, including for gross negligence, willful misconduct, or statutory consumer rights.

13. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at support@acuprep.com and give us 30 days to resolve the dispute informally — most issues are fixed this way. Claims that are not resolved informally must be brought in the state or federal courts located in Virginia, and both parties consent to their jurisdiction — except that you may bring a qualifying claim in your local small-claims court, and nothing in this section displaces consumer protections of the place where you live that cannot be waived by contract.

14. Changes to these terms

We may update these terms as the service evolves. Material changes will be presented for acceptance in the app before they apply to you (each acceptance is recorded with the version you accepted), and continued use after acceptance constitutes agreement. If any provision of these terms is found unenforceable, the rest remain in effect; these terms and the Privacy Policy are the entire agreement between you and AcuPrep LLC regarding the service.
